Limited Warranty Policy



Revised: January 2026

This Limited Warranty Policy applies to the products listed below (each, a “Product”) and is given by MediBeacon Inc. (“MediBeacon”) only to the original purchaser of the Product from MediBeacon or any MediBeacon authorized reseller. Except where prohibited by law, this Limited Warranty does not extend to any subsequent Product owner or other person to who the Product is transferred.

Limited Warranty

Subject to the limitations below and as long as used in accordance with the instructions for use, MediBeacon warrants to the original purchaser of a Product (“Purchaser”) for the time period below (“Warranty Period”) that the Product will be free from defects in materials and workmanship (the “Limited Warranty”).

MediBeacon limits the duration and remedies of all implied warranties, including without limitation, the warranties of merchantability and fitness for a particular purpose to the duration of the Warranty Period. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.

Product Warranty Period of Component
MediBeacon® TGFR™ Monitor Thirteen (13) months from date of shipment.
MediBeacon® TGFR™ Reusable Sensor The lessor of (a) up to five (5) uses, and (b) ninety (90) days from the date of shipment to the end-user customer.
MediBeacon® Preclinical MX One (1) year from date of shipment.

 

This Limited Warranty does not apply to any non-MediBeacon product, even if included or sold with a Product. You should refer to the Terms and Conditions (link provided below) for additional details.

If a Product becomes defective during the Warranty Period, MediBeacon will, at its sole option, either repair or replace the defective Product, free of charge to you. Return shipping charges for Products qualifying for the Limited Warranty hereunder shall be paid by MediBeacon. The Warranty Period is not extended if MediBeacon repairs or replaces the Product. The Limited Warranty will apply to the repaired or replaced Product for the remainder of the original Warranty Period, or 30 days from the date of replacement, whichever is longer, or for any additional period of time that may be required by applicable law.

To request Product repair or replacement under the Limited Warranty, please follow the steps under “How to Return a Product or Obtain Warranty Service” below.

What Is Not Covered?

While the Products are in its possession, you agree to perform routine maintenance and to use such Products only in the manner for which they are intended and otherwise in compliance with the instructions and warnings set forth in the instructions for use.

This Limited Warranty does not cover malfunction or damage due to: (a) improper use of any Product; (b) unauthorized modification or repair of any Product, including, without limitation, Product software; (c) use of any Product in a manner which is not in accordance with the manufacturer’s specifications or instructions for use; (d) use of any Product in combination with any product, part, or accessory not intended by MediBeacon specifically for use with such Product; (e) accidental damage, (e.g. dropping the TGFR™ Monitor, resulting in a cracked screen and / or liquid damage); or (f) tampering, negligence, or misuse, including liquid immersion, autoclaving, overstress or mechanical shock, ETO sterilization or the use of unapproved cleaning solutions. Damage resulting from any of the foregoing may void this limited warranty as determined by MediBeacon in its sole discretion.

Limitation of Remedies & Liability

The remedies in the Limited Warranty are your only remedies and MediBeacon’s entire liability for any breach of the Limited Warranty. MediBeacon’s liability under any circumstances will not exceed the actual amount paid by you for the defective Product, and under no circumstances will MediBeacon be liable for any consequential, incidental, special, or punitive damages or losses, whether direct or indirect.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In these states, the liability of MediBeacon, its licensors, and affiliates will be limited to the greatest extent permitted by law.

How to Return a Product or Obtain Warranty Service

To ensure efficient processing, please obtain a Return Material Authorization (RMA) number from MediBeacon’s Customer Service before shipping the product. This number should be clearly noted on the documentation inside the shipping container. If the RMA number is not recorded, there is a risk that MediBeacon may be unable to accept the package.

MediBeacon will analyze the returned Product and determine whether the Product falls within the exclusions described above.

If the returned Product falls under the Limited Warranty, MediBeacon will ship a repaired or replaced Product to you free of charge. If the returned Product does not fall under the Limited Warranty, you will be responsible for the cost to repair and the shipping costs to return the Product back to you.

Other Important Notices

The rights provided to you under the Limited Warranty are provided in addition to your rights and remedies under consumer protection laws and do not affect your legal (statutory) rights under applicable law.

The Limited Warranty is offered subject to MediBeacon’s Terms and Conditions for the applicable Product, which may change from time to time. You can find the latest version of the Terms and Conditions at https://www.medibeacon.com/terms-conditions/ or by calling MediBeacon Customer Service at 1-800-669-8326. If there is a conflict between the Terms and Conditions for a Product and the Limited Warranty, the Limited Warranty will prevail. No MediBeacon reseller, distributor, agent or employee is authorized to make any modification, extension, or addition to the Limited Warranty.

Any product returned to MediBeacon without a valid warranty claim or without an RMA number (except with respect to the MediBeacon® Preclinical MX which does not require an RMA number)  may be rejected, returned at sender’s cost (subject to prepayment), or kept for 30 days and then disposed of at MediBeacon’s option.
